(題目) 乙在私人企業擔任出納工作，當發生財務困境時，其妻甲向乙建議，可將乙經手的錢財作為應急之用，再設法回補。乙正擬侵占經手的錢財時，適逢公司連日稽查業務，不敢妄動。數日後，甲再向乙提議，業務稽查後是最佳的下手時機，乙於是布局侵占。甲獻計後，卻心生不安，在乙尚未得手前，勸乙打消侵占念頭，但沒有積極的阻止行動。乙後來因職務調動，而無法遂行侵占。試問：甲前後兩次建議乙侵占，是否有罪？（25分）對於著手問題有下列,想請教大家 (一)第一次侵占之建議乙正擬侵占經手,是否僅為"預備犯" (二)第二次侵占之建議乙布局侵占,依主客觀混合說,對侵占業務的直接可能性已然提高,乙為著手 -- -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 220.139.123.91
