18. 甲將所有A車一部以50萬元售予乙，乙將之贈與丙，均依讓與合意並交付。若甲主張意思表示錯誤而撤銷與乙間之買賣契約，甲得主張的權利為何? 我有問題的只有AC選項 A.甲得依不當得利規定向丙請求返還A車（考選部答案） C.甲僅得向乙主張不當得利返還請求權我想問啊，車的移轉是基於乙的合法有權處分若甲乙間的買賣契約因錯誤撤銷，但物權行為本身並沒有被撤銷啊乙還是合法有權處分，甲基於不當得利請求乙返還A車，於車已返還不能時請求返還價額題目已經說死說是撤銷"買賣契約"根本與物權行為無涉除非說甲基於錯誤一併撤銷物權行為與債權行為而至乙為無權處分才有說向丙主張不當得利的可能我的想法是哪邊出了問題??? 有人跟我一樣有這個問題的嗎???? 然後....我想要釋疑怎麼釋疑呀?!?!?! -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 218.173.45.31
