各位前輩好，客觀歸責好難，我又碰到了一個難題想請各位前輩解惑。 有題題目如下： 甲因家中大火而背著五歲兒子逃往五樓頂樓等待救援， 由於火勢往頂樓竄升，甲保住兒子性命的唯一途徑是將兒子丟下樓 讓準備好救援的鄰居接住，否則一定會被燒死。 儘管這樣做也有生命危險，甲仍孤注一擲， 卻因鄰居沒算準位置而漏接，導制兒子死亡。 以上，是個很常見的例子，我的疑問不是甲為什麼有創造風險(獨立製造新風險)， 也不是甲最後可以主張緊急避難來阻卻違法。 我的問題是，為什麼在客觀歸責風險實現的層次中， 甲不可主張「欠缺義務違反之關連性」(結果的可避免性)來阻卻客觀歸責? 甲就算不把兒子丟下樓，依題示，兒子必死無疑， 所以我就想說可以主張行為人所未遵守的法律義務即屬一種無效義務， 而判定風險並未實現，故所發生的結果不可歸責於行為人。 這樣的話不是在客觀歸責上就阻卻違法了，不用討論到違法性跟罪責了嘛?? 我的觀念一定有錯…想請各位前輩教導，謝謝。 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.240.149.96
