出處：新白話六法-民事訴訟法第26條因為民訴法自己光看講義實在看不懂，向圖書館借了這書來做補充這條文給了一個例子 Q：王先生和王太太結婚10年，而後王先生因積欠債務而逃亡二年多王太太後來請律師起訴要求王先生履行同居義務假設王先生目前住在台北，但王太太卻向桃園地方法院提起訴訟而開庭當日王先生沒有抗辯桃園地方法院沒有管轄權直接就有沒有履行同居義務之部份向法院進行抗辯請問此時法院應如何處理??
