有幾題民法問題希望能和大家一起討論 1.甲中年喪偶，有子女乙、丙、丁三人。甲對戊負有債務300萬元。甲死亡時該債務已屆清償期。乙丙丁為遺產分割時，約定由乙承受該300萬元債務，但戊未同意。遺產分割5年後，戊可向丁請求返還多少金額？ Ans:300萬元想法：民法1171條2項過5年免除不適用此題，是因為非“債權清償期在遺產粉割後“嗎？那請問清償期在遺產分割前者之債權請求權時效為何？ 2、甲向乙借貸a車，乙表示同意，雙方達成合意但尚未交付a車，甲與乙契約效力為何？ Ans:無效請問是因為借貸契約為要物契約，需交付物後才會成立？懇請解答，謝謝 -- Sent from my Android -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 111.82.245.56 ※ 文章網址: https://www.ptt.cc/bbs/Examination/M.1428153522.A.98D.html
