出自 陳曄老師 100年總複習講義 其中有幾題疑問， 想請教我觀念哪邊錯誤，謝謝。 1. 甲現年23歲，但因精神障礙而無法辨別事務其為： (A)完全行為能力人 (B)限制行為能力人 (C)無行為能力人 (D)受輔助宣告人 答案是A 請問甲不是精神障礙了嗎？ 還是因為題目沒說明已監護宣告， 所以還是要選擇有行為能力？！ 2.甲出售丙之機車予乙，在民法上： (A)若甲並非機車之所有人，則甲乙之買賣契約無效 (B)未經丙之同意，該移轉機車行為效力未定 (C)若甲已經辦理行照過戶，則乙取得所有權 (D)縱然丙之機車遭甲偷竊，只要乙是善意，丙便不得向乙主張任何權利 答案B 我不解的是基於保障交易安全， 乙應該取得機車了 丙應是向甲提出損害賠償， 為何是效力為定？ 3.甲於86／10／12向乙訂製衣服乙套，約定一個月後交貨，其交貨日為何？ (A)86/11/12 (B)86/11/13 (C)86/11/14 (D)86/11/11 答案B 始日是86／10／13， 那末日不是86／11／12嗎？ 手機輸入可能排版亂掉 但我真的不懂 在此，先謝謝大家的回答喔！ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 116.59.233.111
