[問題] 應考資格、各種國考疑難雜症等，以有正確作法、答案者為主 (不包括書裡的疑問)。若問題如人生規劃、讀書計畫等，無一定作法、答案者，請用閒聊選項。人民不服臺北市政府衛生局辦理臺北市政府委任事件所為之行政處分，訴願應由何機關管轄？ (A)臺北市政府衛生局 (B)臺北市政府 (C)衛生福利部 (D)內政部答案b 請問a為何不行呢？訴願法第8條規定，有隸屬關係之下級機關依法辦理上級機關委任事件所為之行政處分，為受委任機關之行政處分，其訴願之管轄，比照第四條之規定，向(受委任機關或其直接上級機關提起訴願)。如果問了笨問題很抱歉。感覺這好像是基礎問題。會的人能幫我解答一下嗎？謝謝！ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 219.85.239.61
