參考板上以及陳子平教授的著手實行前共同正犯關係的脫離，對於共同正犯關係的脫離仍有些疑問，我目前的想法是可分成兩種第一種：即實務與多數學說見解-仍從犯意聯絡與犯行分擔做判斷 1."著手前"脫離關係：脫離者有"中止共同犯罪意思的表示"(藉故消失不算)及 "未參與犯罪行為之實行或積極的防止行為"，不論結果發生與否，均可認為脫離共犯關係。 2."著手後"脫離關係：脫離者除要有"中止共同犯罪意思的表示"外，必須"積極防止結果的發生"，始有共同正犯關係的脫離。第二種：少數學者提出的"共犯關係脫離理論" 主張不用區分著手前後，脫離者必須切斷與他共同正犯在物理性與心理性的因果性，亦即將自己的行為所造成的危險性予以消除，才有共同正犯關係的脫離，而僅就切斷前的行為負責即可。以上是我的見解，不知道我這樣的分類是否有誤，希望板上大大能解答一下，另外，我有看到可以類推適用準中止犯的論述，看不太懂在表示什麼，可否指點一下，謝謝!!! -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 223.142.172.6
