[課業] 國考課業相關問題，非歷屆考題的討論，如學理觀念的釐清。 各位前輩好 在羅律師刑訴課本看到例題如下 檢察官偵辦廠商甲行賄公務員乙之案件,甲於偵查中坦承違背職務行賄罪,檢察官 對之為緩起訴處分,並定三年緩起訴期間,對乙以違背職務受賄罪提起公訴, 經法院審理結果判決乙無罪,問: 若法院判決乙無罪時,甲之緩起訴處分已確定, 甲向檢察官請求撤銷緩起訴處分是否有理由? 老師 是說 甲緩起訴"期滿產生實質確定力"不得撤銷緩起訴 可是從題目上只看到甲之緩起訴處分已確定,並沒有緩起訴期限屆滿阿@@? 實質確定力應該是緩起訴期限屆滿才有的吧? 謝謝指教~ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 114.45.142.138
