看了葉啟洲師和劉台大的保險法爭點整理提到保險條款競合保險人如何給付的問題不負責任條款溢額賠償條款比例分擔條款臚列了各種保險條款競合優先給付的情況但是好像都只有結論小弟想請教的是這種只能強記嗎? 例如甲乙之契約有溢額賠償條款，乙保險人僅就甲由丙處獲賠不足部分負責其中若甲丙為不負責任條款則由主契約丙賠償甲就上例的情形，為什麼甲丙之不負責任條款要優先賠償？感謝大家了:) -- Sent from my Android -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 211.76.93.40 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1410365276.A.C5C.html
